If you sell non-food products in the European Union (EU) and Northern Ireland (NI), the General Product Safety Regulation (GPSR) introduces new compliance requirements starting December 13, 2024. These regulations aim to ensure that buyers in the EU and NI receive safe and compliant products.

What Does This Mean for Sellers?

To comply with the GPSR, sellers must include the following information in their product listings:

1. Product Manufacturer’s Information: Name and contact details (postal address, email, or contact link). Contact details for an EU-based Responsible Person if the seller is located outside the EU or NI.

2. Safety and Compliance Details: Safety warnings, product labels, manuals, and usage instructions.

3. Product Identification: Clear product identifiers, images, and product type details.

Failure to comply may result in your listings being hidden from buyers in the EU and NI.

What Type of Information Should Be Included?

You must display applicable safety details, such as:

  • Contact information about the manufacturer or any other representative.

  • Instructions for safe use and disposal.

  • Safety warnings or labels (e.g., chemical hazard warnings), product manuals or any related documentation.

This information can be presented as images, labels, pictograms, or statements.

Who Does This Apply To?

These regulations apply to sellers listing products sold within the EU.

If you don’t sell to EU customers, these changes don’t apply to you.

If you are a US-based seller:

  • Selling domestically: GPSR does not apply.

  • Selling to EU or NI customers: You must comply and designate an EU Responsible Person that is registered in the EU.

Who Can Be the EU Responsible Person (EU RP)?

The EU or NI-based Responsible Person can be:

  • The manufacturer (if established in the EU or NI).

  • An importer, if the manufacturer is not based in the EU or NI.

  • An authorized representative of the manufacturer.

  • A fulfillment service provider, if no other entity is based in the EU or NI.

Responsibilities of the EU Responsible Person

The designated Responsible Person must:

  • Ensure labeling, declarations of conformity, and technical documentation are compliant and available for market surveillance authorities.

  • Cooperate with market surveillance authorities to address any non-compliance.

  • Provide evidence of safety checks if requested by authorities.

What Happens If I Don’t Comply?

Listings that do not meet GPSR requirements may be hidden from buyers in the EU and NI. Non-compliance may also result in regulatory penalties.

Am I banned automatically and immediately?

No, you will be contacted by an authority to verify your compliance.

What should I do with requested compliance information and documents?

How to Update Your Product Listings

We cannot edit your existing published products directly for compliance. However, we’ve created a pre-filled product description sheet for you.

The sheet includes compliant GPSR product information for each item.

You can copy and paste the missing details to your description directly in your Shopify or Etsy listing, and fill in the missing details (like your company information).

Our team is working to update new product descriptions across the catalog and Product Editor. Future listings will have the option to include GPSR-compliant descriptions.
